A. General terms and conditions

1. Scope
These terms apply to all deliveries and services provided by tsdd GmbH through https://fabrik4.ch and to orders placed by email or telephone. Different terms apply only if agreed in writing.

2. Quotations and prices
Prices are in CHF, excluding shipping, with VAT included or excluded as indicated. Quotations are valid for 30 days. Technical changes and production-related tolerances are reserved.

3. Orders and artwork
Orders are binding. Customers are responsible for providing correct delivery and billing details and for the quality and compatibility of supplied print files. File checks and artwork preparation are available on request at an additional charge.

4. Proof approval
Production of personalised products begins only after written approval. Content changes are not possible once approval has been given.

5. Production tolerances
Variations customary in the industry (colour shade, cutting or positioning, material batches, quantity ±5%) do not constitute a defect.

6. Delivery and transfer of risk
Delivery times are indicative. Delays caused by force majeure, material or supply shortages, or late submission of artwork do not give rise to compensation. Benefits and risks pass to the customer upon dispatch. Collection is available by arrangement.

7. Shipping and express service
Shipping costs are shown at checkout or in the quotation. Express service is available subject to availability and an additional charge.

8. Payment
Available payment methods: TWINT, card, PayPal, advance payment and invoice. Invoices are payable within 10 days. Late payment may incur reminder fees and default interest. We reserve the right to require advance payment.

9. Retention of title
Goods remain the property of tsdd GmbH until payment has been made in full.

10. Inspection and notification of defects
Deliveries must be inspected immediately. Obvious defects must be reported in writing within 5 working days. Where a defect claim is justified, we will provide rectification, replacement or a credit. Further claims are excluded to the extent permitted by law.

11. Cancellation and returns
There is no right of withdrawal for personalised or made-to-order products. Returns require prior agreement.

12. Third-party rights and references
Customers confirm that supplied content (logos, designs, photos and fonts) does not infringe third-party rights. We are granted the non-exclusive usage rights necessary for production. Photos or logos are used as references only with consent.

13. Liability
To the extent permitted by law, the liability of tsdd GmbH is limited to wilful misconduct and gross negligence. Liability for indirect damage, loss of profit or loss of data is excluded.

14. Governing law and jurisdiction
Swiss law applies. The place of jurisdiction is Buttisholz (LU), unless mandatory law provides otherwise.

2. Purposes of data processing
We process personal data to handle orders and enquiries, communicate, arrange shipping and payment, maintain accounts and improve our offering.

3. Categories of data
Basic details (name, address, contact details), order, payment and delivery data, enquiry and upload content (print files), and technical data (IP address, timestamps and log files).

4. Sources of data
We receive data directly from you (orders, contact forms and file uploads) or automatically when you visit the website (server logs and technically necessary cookies).

5. Cookies and tracking
We use technically necessary cookies (for example, for the shopping cart and login). We use statistics and marketing tools only where they are necessary for operation or consent has been given. Settings can be adjusted in your browser.

6. File uploads
Files (such as logos and graphics) can be uploaded for personalised products. They are used exclusively to fulfil the order and are stored in connection with the relevant project.

7. Disclosure to third parties
Data is disclosed only where necessary, for example to payment providers (TWINT, PayPal and card providers), logistics and shipping partners, or printing and installation partners. Appropriate agreements are in place with data processors.

8. Data locations and protection
Data is processed primarily in Switzerland or the EU. When data is transferred to other countries, we ensure an adequate level of protection. We protect data through organisational and technical measures (access restrictions, updates and backups).

9. Retention
We retain data only for as long as necessary for its purpose or to meet legal obligations, particularly under commercial and tax law.

10. Rights of data subjects
